Introduction Global Activities International (“Zwinaartrs”) operates a handcrafted e-commerce platform consisting of a website and a mobile application. These terms and conditions apply to buyers and seller ZwinaArts on the website and app. The following terms and conditions of sale govern all transactions made on the Global Activities International (“Zwinaartrs”) web catalog. Any order placed on this site assumes the customer’s unconditional and irrevocable acceptance of these conditions.   Article 1 : object This contract is a distance contract whose purpose is to define the rights and obligations of the parties in connection with the sale of products of the company Global Activities International (“Zwinaartrs”), on the Internet, through the platform. The present conditions of sale aim at defining the contractual relations between ZwinaArts and the purchaser, the conditions applicable to any purchase carried out by the means of the website and the application ZwinaArts. The acquisition of a product through the present website and the application implies an acceptance without reserve by the buyer of the present conditions of sale, with which the buyer recognizes to have been acquainted before his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the website ZwinaArts, and the application ZwinaArts, is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity, allowing him to commit under these general conditions of sale. Global activities International (ZwinaArts) reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site and its application. Consequently, the applicable conditions will be those in force at the date of the order by the buyer.   Article 2. Products The offered products are those which appear on the site and the application ZwinaArts, within the limit of available stocks. The site ZwinaArts reserves the right to modify the assortment of products at any time. Each product is presented on the site in the form of a description of its characteristics: use, composition, etc. The photographs are the most faithful possible.   Article 3. Currency and price The currency used for the sale price is the American dollar ($). The ZwinaArts website and application reserves the right to modify its prices and currency at any time. The price announced for each product on the ZwiaArts website and application is the only one applicable at the time of the order by the buyer. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased according to the total amount of the order.   Article 4. Mode of payment To pay for your order, you choose the payment method among those proposed by ZwiaArts on the payment page. In this case, the transaction for a debit of your account is made on the day following the date of the delivery confirmation. Your multi-channel payments are secured by the Centre Monétique Interbancaire (CMI) which offers a fully secure payment service. The Consumer guarantees ZwiaArts that he/she has the necessary authorization to use the method of payment chosen by him/her when validating the Order Form. In the event of payment by credit card, the provisions relating to the fraudulent use of the means of payment provided for in the agreements concluded between the Consumer and the issuer of the card between the Company ZwiaArts and its banking establishment apply.   Article 5. Order and payment conditions Before any order, the buyer must create an account on the website or the application ZwinaArts. The account creation section is accessible directly from the side menu bar. At any time the buyer can consult his profile from his account and have access to the sections Order status, profile, order history… The authorized payment method is online payment via Paypal or credit card: the buyer selects the products he wants to order, then groups them in the “basket”, modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. The buyer chooses the payment method for his order: “Payment by Paypal or credit card”. The next step is the verification of all the information by the buyer, the reading and acceptance of these general conditions of sale by checking the corresponding box. After this step, the buyer is invited to validate his order by clicking on the “Confirm my order” button. At this stage, the buyer is redirected to the secure Paypal or credit card interface in order to securely enter his Paypal or credit card account identifiers. Once the payment is accepted, the order is recorded and the contract is definitively concluded. In case of fraudulent use of the card, the buyer can ask for the cancellation of the payment by card, the amount paid will then be credited or refunded. The responsibility of the bank card holder is not engaged if it is proved that the disputed payment was made fraudulently, at a distance, without physical use of his card. To obtain reimbursement for the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debt in writing with his or her bank within 70 days of the transaction. The sums debited will be reimbursed by the bank within a maximum of one month after receipt of the written objection filed by the cardholder.   The confirmation of an order implies the acceptance of the present terms of sale, the recognition of having perfect knowledge of them, and the renunciation to prevail itself of its own conditions of purchase. All data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an e-mail address and if he/she has entered it on the order form, the website and the application of the company ZwinaArts will send him/her by e-mail the confirmation of his/her registered order. Proof of transactions paid by credit card The data recorded by the CMI on the Multi-channel payment platform on behalf of ZwinaArts constitute the proof of all the commercial transactions passed between you and the company ZwinaArts.   Article 7. Reserve of property The site ZwinaArts keeps the full and whole property of the sold products until the complete payment of the price, in principal, expenses and taxes included.   Article 8. Return of the products The buyer has a period of fourteen working days from the date of delivery of his order to make use of his right to return the product to the seller for exchange or refund without penalty, except for the return costs which are at the expense of the buyer.   Article 9. Delivery Delivery is made to the address indicated on the order form. The orders are made with several carriers such as: DHL, Aramex, FedEx or others. The delivery service is provided with a follow-up. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer refunded. The website and the ZwinaArts application can provide the buyer with the tracking number of his order by e-mail. The buyer is delivered to his address: home, office, other. In case of the absence of the buyer, he will receive a notice of the passage of the deliveryman, which will allow him to fix another delivery date, or to deposit the order in the nearest transport agency. The risks related to the transport are at the charge of the buyer from the moment the order leaves the premises of the company ZwinaArts. The buyer is obliged to check the condition of the packaging and the contents of the goods upon delivery in the presence of the carrier’s employee or the delivery person. In case of damage during transport, any complaint must be made to the carrier within three days after delivery.   Article 10. Intellectual property All products of the site and the application ZwinaArts are and remain the intellectual property and exclusive company of Global Activities International. No one is allowed to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.   Article 11. Personal data The site and the ZwinaArts application are committed to preserving the confidentiality of the information provided by the buyer, which he would be led to transmit for the use of certain services. For this reason, the Internet user has a right to access, modify, and deletion of the information concerning him.
